    This document outlines the key matters on handling information and data in the company.  It is important to know that your action may lead to unintended consequences that may result in severe consequences for the company or yourself.

    I. Information Sensitivity

    As a financial information technology company, we provide information that may be used and relied on by financial professionals across multiple jurisdiction.  It is our responsibility to provide factual, verified and credible information to financial professionals.  Our work has potential impact on the financial market, economy and society, and may in situations, be beneficial to a selected group, community, institution or country, while adverse to another.  It is important to be vigilant at all times, when representing the company or subsidiaries, in all areas of work, including casual emails or conversation.

    Moody’s Granted Case to HK Final Court of Appeal for SFC HK$11 Million Fine for Unfair Reporting

    Hong Kong Court of Final Appeal has granted leave to Moody’s Investors Service HK (Moody’s) to take it’s disciplinary case to the Court of Final Appeal.  Moody’s is facing an HK$11 million fine (US$1.41 million) for unfair reporting in its report titled “Red Flags for Emerging-Market Companies: A Focus on China” published on 11th July 2011.

    Moody’s report caused more than half of the covered HK-listed companies to drop between 5% to 16.8% the following day.  The credit rating agencies listed red flags (negative) assigned to 6 companies in the report, providing leading actions (red flags ~ triggering sell decisions), despite assessment by Moody’s analysts showing no significant correlations between the red flags and companies’ credit risk.

    II. Confidentiality

    Unless otherwise stated, all works from the company are confidential, and shall not be divulged to any parties other than the authorised personnels in the company, or specified clients or prospects or institutions that may have a direct or indirect, existing or potential commercial relationship with us.

    III. Data Protection

    All information of individuals or companies are protected in our company, and assessed on a need to basis.  Across jurisdictions, breaches may result in heavy fines, civil or criminal proceedings.  

     

    • I understand and I acknowledge the sensitivity of handling sensitive information, keeping information confidential and protecting data of individuals and companies.  
    • I will ensure that I upkeep best practices and comply with company policies, and when in doubt, to ask or otherwise, take appropriate actions that will not infringe any laws or to put the company at risk.
    • I agree that I am willing to undertake work that may put myself in a situation of breaching above I, II and III.  
    • This is an interim memo, to ensure all designated staffs understand the importance of our work, severity of negligence or misjudgement, till the company implement a more complete guideline and policy.
